Family Court

Virtual Clerk’s Office

The Family Court’s virtual clerk’s office allows the public to remotely conduct business traditionally conducted at the counters in the courthouses. The virtual clerk’s office can be reached from any electronic device having a microphone and audio-visual capabilities including a smart phone. By clicking the “Virtual Family Clerk” box below, a member of the public will be able to speak with a clerk face to face in real time and obtain assistance without having to enter a courthouse, take time off from work, or contend with traffic, parking, or child care.

Additionally, the public may also contact the virtual clerk’s office by email at virtualfamilyclerk@courts.ri.gov. The virtual clerk’s office will be open from 8:45 a.m. to 3:30 p.m. during the days that the court is open for business.

Guide and File

By clicking the “Guide and File” box below, you can finalize a divorce. The interview will produce two (2) different forms that will need to be filed separately. Please follow the filing instructions below for each one.

Guide and File

You are not legally divorced until both the Decision Pending Entry of Final Judgment and the Final Judgment forms have been filed with the court and signed by a judicial officer.

Filing Form #1: Decision Pending Entry of Final Judgment

The form titled “Decision Pending Entry of Final Judgment” must be filed with the court within thirty (30) days of the date of decision (the court date when the judicial officer granted the divorce).

Filing Form #2: Final Judgment

The form titled “Final Judgment” cannot be filed until three (3) months after the decision date. Please keep this form in a safe place until the three (3) month waiting period has expired and then file your “Final Judgment” form with the court.

If the Final Judgment is not entered within two hundred seventy (270) days from the date of decision, Final Judgment may be entered by written consent of the attorneys or parties. If the parties do not consent, a motion to enter the Final Judgment out of time will be required.

Please print your documents and file with the clerk’s office. You may file your documents electronically. More information regarding electronic filing can be found here. You may also file your documents by mailing them to the appropriate clerk’s office at the address listed below.
